Advisory Team is responsible for providing civil legal advice on IP matters to government bureaux and departments, overseeing the development of the collaborative relations and efforts with other IP authorities and international bodies, and supporting the IP Trading initiative by formulating and implementing appropriate strategies and support measures for developing Hong Kong as an IP trading hub in the region.

Copyright Team is responsible for providing legal advice and policy support to the Commerce and Economic Development Bureau in matters concerning copyright and related rights. It monitors and advises the Government on the development of international copyright treaties and related standards. It regularly reviews the copyright regime of Hong Kong and formulates legislative proposals for updating the copyright law of Hong Kong in pace with technological and international developments.

Hearings Team is responsible for undertaking trade mark registrability, opposition, revocation and invalidation hearings, determining all related interlocutory matters, and handing down reasoned decisions.

To oversee the provision of legal advice on matters arising from contentious trade mark, patent and design proceedings.

Trade Marks Team is responsible for overseeing the practice and procedures in respect of applications for registration of trade marks, and their post-registration matters, provision of policy and legal advice to the Commerce and Economic Development Bureau on issues relating to trade marks and the development of laws, procedures and policies relating to trade mark registrations. One of the major tasks currently undertaken by the team is the proposed implementation of the international trade mark registration system under the Madrid Protocol in Hong Kong.

Patents & Designs Team is mainly responsible for overseeing the practice and procedures in respect of applications for grant of patents and registered designs, and their post-grant matters, and providing legal and policy advice to the Commerce and Economic Development Bureau on legislative proposals and other issues relating to patents and registered designs. One of the major and far reaching projects currently undertaken by the Team is to implement an “original grant” patent system, refinement of the short term patent system and other related measures in Hong Kong.

To oversee the practice and procedures in respect of patent and designs applications and post-grant matters.
To oversee the provision of policy and legal advice related to designs, including the application of international treaties.
To oversee the provision of policy and legal advice on patent-related issues, including those relating to the implementation of a new patent system (mainly by setting up an original grant patent system and refining the short-term patent system) and the setting up of a local regulatory regime for patent practitioners.
To engage and steer further negotiations with other patent offices for enlisting appropriate technical assistance and support, particularly in areas concerning substantive examination of inventions and training of manpower, for administering the new patent system.

The Registries are mainly responsible for examining trade mark applications, patent applications and design applications; registering trade marks, granting standard patents after substantive examination, granting short-term patents followed by substantive examination if required, registering patents granted by the designated patent offices, registering designs; and handling post-registration matters. The Registries also maintain the registers of trade marks, patents and designs in electronic format and make them available for public search.
